The Ministry of Justice, Ministry of Economy, Trade and Industry, Japan International Dispute Resolution Center (JIDRC), and Japan Commercial Arbitration Association (JCAA) will co-sponsor an online seminar on international arbitration for business transactions with Vietnamese companies.

The launch of the East Asia Regional Comprehensive Economic Partnership (RCEP) will accelerate the development of commercial transactions among Asian countries. Every commercial contract includes dispute resolution clauses, but if the parties are to choose litigation in the local court, they are likely to bear more costs and time in court, with much difficulty in enforcing foreign judgments. Therefore, international arbitration is a more effective measure to resolve legal disputes arising from international commercial transactions of companies in a fair and impartial manner.

The Japanese government has been actively working to revitalize international arbitration by establishing a pro-arbitration legal system, training human resources, and improving related facilities totally fit for international arbitration. This webinar is to show an overview of a public-private effort between the Japanese government and arbitration-related institutions and try to attract both Japanese and Vietnamese companies and practitioners to use Japan as the seat of arbitration. Speakers from Vietnam and Japan will provide information on the status of international arbitration in the resolution of disputes related to trade and investment with Vietnam, especially what kind of issues foreign arbitration institutions should take care of when dealing with a dispute related to Vietnam, recognition and enforceability issues of the foreign arbitration awards.

The speakers will also introduce the smooth and speedy implementation of arbitration procedures and the enforcement of arbitration awards by the JCAA in Vietnam.
