【DAY２「アメリカ大陸における日本の接点：経済、国際仲裁とADR、人材開発の観点から」の概要】
世界トップ3の経済国として、日本は米国やラテンアメリカの国々のビジネスに大きな影響を与えています。日本の活気あふれる国際経済界は国際仲裁に依存しており、日米間の国境を越えた取引の量は、日本における紛争解決の重要性を示しています。そこで、本ウェビナーでは、３つのセッションにおいて、それぞれ次の問題を扱います。
セッション１：日本とラテンアメリカ諸国との間の国際貿易投資協定及び貿易・投資量に及ぼす日本の経済的影響を考えます。また、米国とアメリカ大陸に所在する日本企業が関与する最近の国際仲裁事件のいくつかについて検討します。
セッション２：JCAAの国際仲裁事件に関する統計データと実務、JCAAの仲裁規則の改正や仲裁法改正案など、日本の仲裁制度に関する最新動向を説明します。また、日本の裁判所調停・民間調停、調停教育および仲介訓練の取り組みなどについても説明します。
セッション３：JIDRCの施設での教育および専門訓練に関する概要を説明するとともに、能力開発の方法としてマイアミと日本を通じて若い国際弁護士のための国際仲裁の分野で潜在的な協力について議論します。また、米国の国際仲裁分野で、外国で訓練を受けた弁護士のための法教育と法律実務の機会に関する概要を説明します。

Session 1: Japan’s Economic Partnership and International Arbitration in Latin America
During Session 1 of the webinar, Speakers will provide Japan’s economic impacts on trade and investment volumes of each sector and industry with the number and fact of international trade and investment agreements between Japan and the countries in the Latin America. Speakers will also address a couple of recent international arbitration cases involving Japanese companies seated in the U.S. and the Americas.

Session 2: International Arbitration and ADR Development in Japan
During Session 2 of the webinar, Speakers will present statistical data and practices about the JCAA-administered international arbitration cases and share the current developments on the arbitration system of Japan such as the reform of JCAA’s arbitration rules and proposed amendments to the Arbitration Law. Speakers will also provide an overview of the use of commercial mediation in Japan by considering the historical preference for non-adversarial means of dispute resolution and potential explanations (cultural and institutional) and by explaining the features of court-annexed conciliation and private mediation in Japan before turning to the rising interest in international commercial mediation with the creation of the JIMC, the revision of the JCAA mediation rules, and educational and mediator training initiatives.

10:00 AM ET: Session 3: Developing Capacity in International Arbitration between U.S. and Japan
Session 3 of the webinar will provide an overview on educational and professional training opportunities at the JIDRC’s modern hearing facility and discuss the potential collaboration in the field of international arbitration for young international lawyers through Miami and Japan as a way of capacity development. This session also will provide a brief overview on legal education and legal practice opportunities for foreign-trained lawyers in the field of international arbitration in the U.S.
